1. Introduction

Fodsports Connect (the “App”) is a companion application that lets you pair, configure, and update compatible Fodsports Bluetooth communication devices (such as helmet and headset intercoms). This Privacy Policy describes what information we collect through the App, how and why we use it, who we share it with, how long we keep it, and the rights and choices available to you under the General Data Protection Regulation (GDPR), the UK GDPR, and other applicable data protection laws.

This Privacy Policy is also designed to correspond directly to the disclosures required by the Google Play Data Safety section and the Apple App Store Privacy Nutrition Label for this App (see Appendix A and Appendix B). By downloading, installing, or using the App, you acknowledge that you have read and understood this Privacy Policy.​

3. Scope of This Policy

This Policy applies to the Fodsports Connect mobile application on iOS and Android and to the account, cloud synchronization, and support services that operate alongside it. It does not apply to third-party websites, products, or services that may be linked from within the App, which are governed by their own privacy policies.

5. Permissions We Request
The App requests the device permissions listed below. Each permission is requested at the point it is needed (“just-in-time”), together with an in-app explanation of why it is required — this is our Prominent Disclosure to you before any sensitive permission (Contacts, Camera, Microphone, Call Log) is requested. You may grant, deny, or later revoke any permission through your device's Settings app; declining a permission only limits the related feature.

8. How We Share Your Information

We do not sell your personal information, and we do not share it with advertisers or data brokers. We may share information only in the following limited circumstances:

• Service Providers: Cloud hosting and infrastructure providers who store and process data on our behalf, solely to operate the App and under contractual confidentiality and data-protection obligations.

• Legal Compliance: When required to comply with applicable law, regulation, legal process, or a valid governmental request.

• Protection of Rights: To protect the rights, property, or safety of Fodsports, our users, or the public, as permitted by law.

• Business Transfers: In connection with a merger, acquisition, financing, or sale of assets, subject to this Privacy Policy continuing to apply to your information.

Note: We do not integrate third-party advertising, analytics, or cross-app tracking SDKs. The App's Bluetooth connectivity is implemented using the Qualcomm GAIA Bluetooth communication library, which operates locally on your device to communicate with your paired accessory and does not independently transmit your personal information to Qualcomm or any other third party.

9. International Data Transfers

Our servers and service providers may be located outside of the European Economic Area, the United Kingdom, or Switzerland, including in China, where our backend infrastructure operates. Where we transfer personal data internationally, we rely on appropriate safeguards recognized under applicable law, such as the European Commission's Standard Contractual Clauses (SCCs), to ensure your information continues to receive an equivalent level of protection.

10. Data Security

We use industry-standard safeguards to protect your information, including HTTPS/TLS encryption for data in transit and access controls that limit who can access personal data on our systems. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we become aware of a data breach affecting your personal information, we will notify you and the relevant supervisory authority as required by applicable law.

11. Data Retention

We retain personal information only for as long as necessary to provide the App's services or to comply with legal obligations. After you delete your account, we will delete or anonymize eligible personal information — including your uploaded avatar, synced contact entries, and device binding records — within a reasonable period, unless a longer retention period is required by law (for example, for accounting, security, or dispute-resolution purposes).

12. Your Privacy Rights

Subject to applicable law, you have the following rights regarding your personal information:

• Right to Access: Request a copy of the personal information we hold about you.

• Right to Rectification: Request correction of inaccurate or incomplete information.

• Right to Erasure: Request deletion of your personal information (see Section 13, Account Deletion).

• Right to Restrict Processing: Request that we limit how we use your information in certain circumstances.

• Right to Data Portability: Request your information in a structured, commonly used, machine-readable format.

• Right to Object: Object to processing based on our legitimate interests.

• Right to Withdraw Consent: Withdraw consent at any time for processing based on consent (e.g., by disabling a permission in your device settings), without affecting the lawfulness of prior processing.

• Right to Lodge a Complaint: Lodge a complaint with your local data protection supervisory authority if you believe our processing violates applicable law.

13. Account Deletion

You can permanently delete your account and associated personal data at any time, directly within the App (Settings → Account → Delete Account), without needing to contact customer support. You may also submit a deletion request through our web-based account deletion page or by emailing support@fodsports.com. After identity verification, your request will be processed in accordance with Section 11 (Data Retention).

14. Children's Privacy

The App is not directed to children. We do not knowingly collect personal information from children under 13 years of age (in accordance with the U.S. Children's Online Privacy Protection Act, COPPA) or under 16 years of age (the default age of digital consent under the GDPR, which may be lower in certain EU member states). If you are a parent or guardian and believe your child has provided us with personal information without your consent, please contact us at support@fodsports.com so we can delete it.

15. Tracking, Cookies, and App Tracking Transparency

The App does not display third-party advertising and does not use your data to track you across other companies' apps or websites. Accordingly, the App does not trigger Apple's App Tracking Transparency (ATT) prompt. The App does not use browser cookies, as it is a native mobile application rather than a website.

16. Automated Decision-Making

We do not use your personal information to make decisions based solely on automated processing, including profiling, that produce legal effects concerning you or similarly significantly affect you.

17. Third-Party Services and SDKs

The App does not integrate third-party analytics, advertising, or crash-reporting SDKs that collect personal data. The App uses the Qualcomm GAIA Bluetooth communication library solely to enable on-device communication with compatible Fodsports hardware; this library does not transmit your data to Qualcomm. If this changes in the future, we will update this Privacy Policy and the corresponding Google Play Data Safety and Apple Privacy Nutrition Label disclosures accordingly.

18. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons. Material changes will be indicated by an updated “Last Updated” date above, and where required by law, we will provide additional notice or seek renewed consent. The latest version is always available at the link in Section 19.
